Welcome to The Candy Cab! Please read these Terms and Conditions ("Terms") carefully before placing any order. By accessing or using our website and placing an order with us, you agree to be bound by these Terms and Conditions and our Privacy Policy.
1.1. Products: The Candy Cab specializes in custom-curated candy packages, offered in tiered sizes and specific flavor profiles, as detailed in our Official Pricing Menu.
1.2. Customization: Orders are fulfilled based on the client's selection of Package Tier, Flavor Style, and Bag Type (Regular or Premium). Specific candy items listed in the menu are illustrative examples; while we strive for consistency, final contents may vary based on seasonal availability and sourcing.
1.3. Service Agreement: All confirmed orders require the completion and execution of a separate Custom Candy Package Agreement (Contract), which supersedes these website terms regarding payment schedules and cancellation.
2.1. Pricing: All prices are clearly listed in the Official Pricing Menu and are subject to change without prior notice, except for orders already confirmed via a signed Contract.
2.2. Minimum Order Quantity (MOQ): All orders are subject to a minimum order quantity (MOQ) of 25 bags, as detailed in the Pricing Menu. Orders submitted below the MOQ will not be accepted.
2.3. Lead Time: A mandatory lead time of at least 7 business days is required for all orders. Failure to meet this requirement may result in order rejection or a rush fee, at the sole discretion of The Candy Cab.
2.4. Payment: Orders are secured by a non-refundable deposit due upon contract signing. Final payment must be received in full no later than 7 days prior to the scheduled delivery date. Orders will not be assembled, delivered, or shipped without full payment.
3.1. Non-Refundable Deposit: The initial deposit is strictly non-refundable under all circumstances, as it covers the costs associated with initial design, sourcing, and scheduling.
3.2. Cancellation by Client: If the Client cancels the order after the final payment has been made, refunds will be processed only according to the terms outlined in the signed Custom Candy Package Agreement (Contract).
3.3. Cancellation by The Candy Cab: If The Candy Cab must cancel an order due to unforeseen circumstances or inability to fulfill the order, the Client will receive a 100% refund of all payments made, including the initial deposit.
4.1. Delivery Responsibility: We will deliver packages to the address specified on the Order Form within the agreed-upon time window.
4.2. Client Acceptance: The Client or their authorized representative must be present to inspect and sign for the delivery.
4.3. Post-Acceptance Risk: Risk of loss or damage transfers entirely to the Client upon acceptance of the delivery. The Candy Cab is not responsible for damage, theft, or deterioration of the candy due to improper storage, heat, or humidity once the delivery is complete.
5.1. Handling Facility: The Client acknowledges that all candy packages are prepared in a facility that handles common food allergens, including, but not limited to, peanuts, tree nuts, milk, soy, and wheat.
5.2. No Guarantee: We cannot guarantee that any package is 100% free of allergens or cross-contamination.
5.3. Client Responsibility: The Candy Cab assumes no liability for allergic reactions or health issues arising from the consumption of our products. It is the sole responsibility of the Client to inform their guests of this allergy risk and to request specialty dietary packages, which may incur a separate surcharge for dedicated sourcing.
6.1. Client IP: For Premium Bag orders requiring custom branding or logos, the Client warrants that they own the rights or have permission to use any artwork, logos, or text provided to The Candy Cab. The Client agrees to indemnify and hold The Candy Cab harmless against any claim arising from the use of such intellectual property.
6.2. Cab IP: All designs, logos, text, and graphics created by The Candy Cab for general use are the property of The Candy Cab.
The Candy Cab's liability for any and all claims related to this agreement and the services provided is limited to the Total Contract Price paid by the Client to The Candy Cab.
These Terms shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict of law provisions.
